Rider Loses Erection Appeal

SAN FRANCISCO – A state appeals court here has rejected an appeal filed by a man from Sausalito, CA who claimed he suffered from acute priapism (a painfully prolonged erection) after riding his 1993 BMW motorcycle for two hours. Henry Wolf had sued BMW and seat-maker Corbin in 2012, but the appeals court this week affirmed an earlier judgment against the rider.

Wolf had claimed that vibrations in the “ridge-like” motorcycle seat caused the condition that lasted several days and that he was forced to seek treatment at Marin General Hospital and with specialists. His lawsuit alleged product liability, negligence and negligent infliction of emotional distress.

The three-judge appeals court on Tuesday affirmed the original San Francisco Superior Court decision to dismiss the case, saying Wolf’s appeal “fails to comply with the rules of appellate procedure” and “contains no intelligible argument.” Wolf was ordered by the panel to pay the defendants’ costs on the appeal, which could be tens of thousands of dollars.
